Products for sale on www.bottegadelsarto.com (hereafter the “Site”) are sold and billed by:

1. YOU CONCLUDE THE CONTRACT BY ACCEPTING THE GENERAL TERMS OF SALE
1.1 Bottega del Sarto offers for sale on its Site products intended for final consumers, i.e. those who purchase for purposes unrelated to any commercial, entrepreneurial or professional activity carried out (the “Customer”). Consequently, Bottega del Sarto reserves the right not to accept orders from parties other than “consumers” or orders that do not comply with its commercial policy.
1.2 By placing an order in the various ways provided, according to the order form on the Site (hereinafter the “Order”), the Customer declares that he/she has read all the indications provided to him/her during the purchase procedure and fully accepts these general conditions (hereinafter the “Conditions”).
1.3 The contract between Bottega del Sarto (hereinafter also referred to as “Seller”) and the Customer is considered concluded with the approval, even partial, of the order by Bottega del Sarto. In the event that the order is not accepted, Bottega del Sarto will still provide timely notice to the Customer.
1.4 You may print or save on a durable medium the current Conditions, in accordance with the provisions of Article 12 of Legislative Decree No. 70/2003 and Article 51 of Legislative Decree No. 206/2005, as amended by Legislative Decree No. 21/2014. 21/2014.
2. MODE OF PURCHASE
2.1 The products offered for sale by Bottega del Sarto are exclusively those listed on the Site at the time the Order is placed, and are described in their respective information sheets.
2.2 To place an Order, the Customer is required to fully complete the relevant form on the Site and submit it following the instructions on the same. Before proceeding, it is necessary to carefully examine the Conditions, as well as the characteristics of the product(s) you intend to purchase, the price (which includes all applicable taxes or duties) and shipping costs (including any extra costs for different or faster shipping options and delivery than standard delivery). Should the Customer wish, he/she may request that Bottega del Sarto issue a tax invoice for the purchase.
2.3 Bottega del Sarto confirms the correct receipt of the Order by an e-mail response, sent to the e-mail address provided by the Customer. This confirmation will concisely include the conditions of purchase, in accordance with current legislation, and will also contain the data entered in the Order by the Customer. This will allow the Customer to verify this information and, if necessary, make timely corrections in case of incorrect data.
2.4 It should be noted that the images accompanying the product description are for informational purposes only and may not accurately represent all of its features. These images may differ, for example in terms of color and size (also due to the specifications of the browser and monitor used to access the Site and view the images).
3. PRICES AND PAYMENT METHODS
3.1 You can make purchases by following the various conditions included on the payments page present of the home page of www.bottegadelsarto.com. Transactions will be processed through a secure server chosen by Bottega del Sarto.
3.2 Under no circumstances and at no stage of the payment process will Bottega del Sarto have access to the Customer’s credit card information or any other sensitive data. Such information will be transmitted via a secure connection directly to the website of the banking institution handling the transaction. No computer file of Bottega del Sarto will retain this information. Therefore, Bottega del Sarto cannot be held responsible for any fraudulent or improper use of credit cards by third parties during the payment process.
3.3 The prices shown on the Site include all applicable taxes and VAT. However, any shipping costs or payment charges will be communicated to the Customer in advance through the Site.
4. DELIVERY OF PRODUCTS AND RELATED EXPENSES
4.1 The purchased products will be delivered to the address provided by the Customer in the Order, respecting the time specified in the same Order. Such delivery will be made by Bottega del Sarto and its logistics service providers, at the cost specified on the Site prior to placing the Order. However, Bottega del Sarto reserves the right to decide whether or not to accept deliveries outside Italian or European borders. In the case of deliveries in Italy and to foreign countries, shipping costs, customs fees and delivery times may be subject to change, as indicated on the shipping page, located on the home page of the website www.bottegadelsarto.com.
4.2 Bottega del Sarto guarantees delivery within 4/6 business days for orders placed Monday through Friday before 4:00 pm. Delivery times provided by Bottega del Sarto are for guidance only. Any delays with respect to these times or split deliveries shall not entitle the Customer to refuse delivery or claim compensation or indemnity.
4.3 Upon delivery of the products, we ask the Customer to sign the delivery document after proper verification:
- That the number of packages being delivered corresponds to what is indicated in the transport document.
- That the packaging is undamaged, undamaged, not wet or otherwise altered, including in the sealing materials (adhesive tape or metal strapping).
4.4 Any damage to the packaging and/or product, or discrepancies in the number of packages or markings, must be promptly noted and reported immediately. It is recommended that a specific note be made on the delivery note of the product to be returned to the carrier.
4.5 Any problems regarding the physical integrity, correspondence, or completeness of the products received must be reported within a period of 7 days from the date of delivery.
5. RIGHT OF WITHDRAWAL
5.1 The Customer has the right to withdraw from the purchase contract without having to provide any reason and without incurring any penalty, within a period of 15 (fifteen) days from the date of delivery of the products.
5.2 In order to exercise the right of withdrawal mentioned in Article 5.1 above, the Customer may use the form specially provided inside the package of the product subject to return (the “Returns Form”).
5.3 In case of withdrawal, the Customer must return the products to Bottega del Sarto within a period of 5 (days) days from the date of withdrawal itself. The return can be made by following one of the following methods, at the choice of the Customer:
- Return of the returned product(s) to the address indicated in the Returns Form via courier chosen and instructed directly by the Customer (the Customer will be responsible for all shipping costs);
- Return of the product or products subject to return at the courier appointed directly by Bottega del Sarto Industry srl, at the address also indicated in the Returns Form. In the case of return of products in Italy or from foreign countries , shipping costs, customs fees and delivery times may be subject to change, as indicated in the refund and returns policy page, found on the home page of the site www.bottegadelsarto.com.
5.4 Goods must be returned in the same condition in which the Customer received them, complete with all original parts and, if necessary, used only for the time necessary to examine their nature, characteristics and size, with due diligence and without signs of wear or soiling. This must be done in compliance with the following conditions:
For withdrawal to be eligible, the product must be returned in undamaged and complete condition, including all ancillary items such as labels, tags, seals, etc…
The right of withdrawal can be applied to the entire product purchased; it is not possible to exercise the right of withdrawal only on a part of the product (for example: accessories, complements, etc…).
The shipment of the product until the certificate of receipt at the warehouse specified by Bottega del Sarto is entirely the responsibility of the Customer. In the event that the goods are damaged during transport, Bottega del Sarto will inform the Customer so that he/she can file a claim with the carrier and obtain the appropriate refund. The damaged product will be made available to the Customer, and at the same time the request for withdrawal will be cancelled.
Bottega del Sarto will not be responsible in any way for damage, theft, or loss occurring during or in connection with the shipment for the return of products.
5.5 After the return of the products, Bottega del Sarto will conduct appropriate verifications to ascertain their compliance with the conditions and terms established in the previous article. In the event that these verifications are unsuccessful, the Seller will notify the Customer by e-mail of the presence of a decrease in the value of the returned products, resulting from non-compliance with the above conditions. In addition, Bottega del Sarto will indicate the amount that will be deducted from the refund. Alternatively, the Customer will have the option, at its own expense, to recover the products in the state in which they were returned to Bottega del Sarto.
5.6 Bottega del Sarto will proceed with a full refund of the amount already paid by the Customer. The refund will be made within 14 (fourteen) days from the date of withdrawal, through a reversal procedure of the amount charged. The same payment method initially used by the Customer for the transaction will be used, unless otherwise agreed. The Customer will have no cost associated with this refund.
5.7 If the right of withdrawal lapses and the Customer loses the right to return, Bottega del Sarto will arrange for the return of the purchased product to the sender. In this case, the sender will be charged shipping costs and, if a refund has already been made, the price of the product will also be charged.
6.1 All products sold by Bottega del Sarto are subject to a warranty of 24 (twenty-four) months for any lack of conformity, as provided by Title III of Legislative Decree No. 206/2005. 206/2005.
7. COMPLAINTS AND INQUIRIES
7.1 Any complaints or inquiries may be addressed to Bottega del Sarto by sending an email to Customer Service: email@example.com.
9. APPLICABLE LAW
9.1 The contract of sale, as set forth in these Conditions, and its execution shall be governed by Italian law, to the exclusion of the conflict rules and the United Nations Convention on the International Sale of Goods. In case of disputes, the Court of Rome shall have jurisdiction for their resolution.
9.2 In the case of disputes arising from the Conditions, the online Alternative Dispute Resolution body of the Rome Chamber of Commerce may also be approached in advance.
9.3 Finally, it is informed that the European Commission provides a platform for out-of-court alternative dispute resolution, including cross-border disputes, accessible at https://ec.europa.eu/odr.
